    HashKey Referral Pro Program参与者的明确承诺
    • 遵守法律 参与者承诺将遵守与 HashKey Referral Pro Program和 API 使用相关的所有适用法律和法规的所有相关要求。本承诺是对参与者在任何适用法律和法规下的义务的补充，并不解除、取消或替代这些义务。

    • 信息使用和保密 参与者同意通过 HashKey Referral Pro Program获得的所有客户可识别数据（“客户数据”）将仅用于验证推荐奖励。除非有合法的验证需要，否则这些数据不会被个人使用或披露。任何第三方披露需要 HashKey Global的书面同意。
    参与者应对所有保密信息严格保密，仅向有需要知情并受类似限制约束的代表披露。参与者将以保护自己敏感数据的同等谨慎程度保护这些信息，不低于合理的谨慎程度。任何未经授权的披露或丢失应立即通知 HashKey Global。参与者对其代表的合规性负责。

    如果需要根据命令披露，参与者应立即通知 HashKey Global并协助获得保护。
    • 赔偿 参与者同意对 HashKey Global因参与者的任何疏忽、行为不当或过失行为（包括但不限于未经授权使用通过本计划获得的客户可识别数据）而引起的任何和所有索赔、要求、诉讼、责任、损失、成本和费用（包括合理的律师费）进行赔偿并使其免受损害。本赔偿义务在本承诺终止后仍然有效。
     
    • 许可状态的确认 参与者承认HashKey Global是相关监管机构下的持牌机构。参与者承诺不会在适用法律和法规禁止的司法管辖区内以 HashKey Global的名义招揽用户。
     
    • API 用户条款的适用性 参与者承认并同意，本承诺的条款应与参与者与 HashKey Global签订的 API 用户条款（如适用）并行运行。如果本承诺的条款与上述 API 用户条款之间存在任何冲突，则以有利于 HashKey Global的条款为准，并指导各方义务的解释和执行。
     
    • 计划变更 HashKey Global保留随时自行决定更改、修改或取消活动/计划或任何参与者资格的权利，包括由于内部控制措施、系统问题或其他情况，且无需事先通知或承担任何责任。
     
    • 责任 在法律允许的最大范围内，HashKey Global、其关联公司、合作伙伴和员工不对因您参与活动/计划而引起的任何直接、间接、附带、后果性或特殊损害承担责任。这包括但不限于任何资金、利润、数据或声誉的损失。HashKey Global保留对活动/计划规则和奖励的最终决定权。
     
    • 适用法律 HashKey Referral Pro Program的条款（包括本承诺函中的任何条款）受香港特别行政区法律管辖，并应根据香港法律解释和执行，不考虑任何法律选择或法律冲突规则。因本承诺引起的或与之相关的任何争议，包括其存在、有效性或终止的任何问题，应提交并最终由香港国际仲裁中心（HKIAC）根据提交仲裁通知时有效的 HKIAC 管理仲裁规则进行仲裁。仲裁地点为香港。

    Participants of the Referral Plus program understand, agree and guarantee that:

     

    参与此活动并不保证符合资格、获得接受或收到任何奖励、福利或激励。HashKey Global可能对参与条件、要求或限制设定特定标准，并保留拒绝或取消个人或实体参与计划的权利。HashKey Global保留包括根据内部控制、系统问题或其他情况在任何时候根据自己的判断权利修改、更改或取消活动或任何参与者资格的权利，而无需提前通知或承担任何责任。

    Participation in this program does not guarantee eligibility, acceptance, or receipt of any rewards, benefits, or incentives. HashKey Global may impose certain criteria, requirements, or limitations for participation, and it reserves the right to deny or disqualify individuals or entities from participating in the program. Hashkey Global reserves the right to make changes, modify, or cancel the program or the eligibility of any participant at any time at its sole discretion, including due to internal control, system issues or other circumstances, without any prior notice or liability.

    Participants do not represent HashKey Global and must not express opinions or make statements that explicitly or implicitly represent HashKey Global. Participants are strictly prohibited from creating or distributing content targeted at a specific regional audience and shall guarantee that any action taken as a referrer under the Referral Plus program complies with all applicable laws (including any applicable advertising, social media, and/or competition regulations as well as laws and regulations issued by government agencies) and the terms of HashKey Global's platform.

     

    HashKey Global保留随时对其发布的内容（如有）进行审核、修改（无论发布前后）或要求撤除的权利。参与者投放的内容不侵犯任何第三方的知识产权、隐私权、公开权、商标权或其他权利。参与者发布的内容不包含虚假陈述、误导性信息、诽谤、恶意中伤、色情、淫秽、违法、令人反感或其他不当内容。参与者有权和授权HashKey Global转载其发布的内容，并保证其发布的内容符合适用法律、规定和行业标准。

    HashKey Global reserves the right to review, modify (whether before or after publication), or request the removal of any content published by itself (if any) at any time. The content posted by participants must not infringe upon any third party's intellectual property rights, privacy rights, publicity rights, trademark rights, or other rights. The content published by Participants must not contain false statements, misleading information, defamation, malicious slanders, as well as pornographic, obscene, illegal, offensive, or other inappropriate content. Participants have the right and authorize HashKey Global to reproduce their published content and guarantee that the content they publish complies with applicable laws, regulations, and industry standards.

     

    参与者同意不使用付费粉丝、机器人或其他形式的技术来使其显得达到本计划新增用用户目标。

    Participants agree not to use paid followers, bots, or other forms of technology to inflate their new user targets to satisfy requirements under the Referral Plus program.

     

    如参与者未能遵守或违反本计划的条款或义务， HashKey Global保留扣留应支付给的任何奖励，并保留收回在违约事件前根据本计划支付给参与者的任何奖励。参与者同意赔偿、协助和保护HashKey Global及其关联公司、董事、高级管理人员、员工、代理人和受让人，免受因其发布的内容或违反本计划条款而引起的任何索赔、诉讼、损失、责任、费用（包括合理的律师费用）或费用的损害。

    If Participants fail to comply with or violate the terms or obligations of this program, HashKey Global reserves the right to withhold any rewards payable and reserves the right to recover any rewards paid to Participants under this program prior to the event of default. Participants agree to indemnify, assist, and defend HashKey Global and its affiliates, directors, senior management, employees, agents, and assigns from and against any claims, lawsuits, losses, liabilities, expenses (including reasonable attorney's fees) or costs arising from its published content or violation of the terms of this program.

     

    在法律允许的最大范围内，HashKey Global及其关联公司、合作伙伴和员工对于参与者参与计划所产生的任何直接、间接、附带、后果性或特殊损害概不负责，包括但不限于资金、利润、业务、潜在利润、数据或声誉的任何损失。HashKey Global对参与者违反本计划条款或当地法律法规的任何行为不承担责任。

    To the fullest extent permitted by law, HashKey Global, its affiliates, partners, and employees shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from participant’s participation in the program, including but not limited to any loss of funds, profits, business, potential profits, data, or reputation. HashKey Global assumes no responsibility for any act of Participants that violates the terms of this program or local laws and regulations.

    HashKey Global reserves the ultimate discretion regarding the rules and rewards of the program.

As a result, HSK presently has no established market value. The timeline for the potential listing of HSK remains uncertain. In the event that HSK is successfully listed, it may be subject to various trading restrictions in accordance with applicable regulations and laws. These restrictions may include, but are not limited to, limiting the trading of HSK solely to eligible professional investors in select locations and subject to regulatory approval.
